Felony Driving Under The Influence

There are three ways a DUI may go from a misdemeanor DUI to a felony DUI:

  1. If you’re DUI resulted in the death or injury of another person.
    • You may also be charged with DUI vehicular manslaughter or even second degree murder (Watson Murder).
  2. If you have been convicted of four DUI’s within a 10 year period.
    • Any out-of-state convictions for DUI count towards the total over a 10 year span.
  3. If you have at least one prior felony DUI conviction.
