Battery on a Police Officer Charges

Battery can be either a misdemeanor or felony in California.

When it is against a law enforcement officer performing his/her duties, it becomes aggravated battery. Battery against these protected groups can be charged as either a misdemeanor (with an enhancement) or felony, depending on the injuries sustained.

Penalties

Misdemeanor battery is usually punishable by up to 6 months in jail. An enhancement is added which usually results in an extended jail sentence for battery on a police officer.

If this is charged as a felony, it can be punishable by up to 3 years in prison.
