After less than four hours in deliberations, a Fresno jury convicted Daniel Galvan of first degree murder in the shooting death of his wife last year. Daniel Galvan, 36, was charged with murdering his wife, Ann-Marie Galvan, 41, in front of his mother while he was drunk and under the influence of methamphetamines.
The jury also found Daniel Galvan guilty of misdemeanor child endangerment; the couple’s two young children were present in the home when he shot his wife six times with a .380 semi-automatic pistol, however they did not witness the crime.
Galvan’s defense attorney and the prosecution agreed that Galvan shot his wife while relatives were present. However, Galvan’s attorney said his client could not have formed the specific intent to commit murder because he “was in a meth-induced psychosis and in a state a paranoia” following three days of intense drug use. Defense counsel also stated that doctors said Galvan had a mental disorder and an anti-social personality due to his extended drug use and that he therefore couldn’t comprehend what he was doing when he shot his wife.
Daniel Galvan will be sentenced on January 21, 2014. He faces 50 years to life in California state prison.
