Marijuana Drug Charges

Nearly all possession charges are considered felonies in California but there are some exceptions. Marijuana falls under these exceptions.

Possessing less than 28.5 grams (one ounce) of unconcentrated marijuana is an infraction and results in a fine of $100. If the amount is over 28.5 grams, it  can result in max fines of $500 and 6 months in jail.

Penalties for Marijuana Drug Charges

If convicted for marijuana possession, you likely qualify for drug diversion and Prop 36 treatment in lieu of jail time. It is possible to avoid conviction for the crime and have it permanently on your record.

However, if you include intent to distribute or are caught transporting marijuana, it is a felony.
