Meth Possession

It is a crime to possess methamphetamine (also known as meth or crystal). The prosecutor has the discretion to file the charge as a misdemeanor or a felony. Usually, there are two factors that go into this decision:

  1. the amount of methamphetamine involved
  2. the criminal history of the person.

Possession of methamphetamine can receive the same punishment as drug possession. It also qualifies for treatment under Proposition 36 guidelines.
